PLAN AMENDMENT
SUMMARY, HISTORY, AND DISCUSSION

I. SUMMARY

This Plan Amendment Application consists of four (4) requested changes to the Future Land Use Map (“FLUM”) designations for the On Top of the World DRI and Circle Square Woods vested land.  The Applicant, On Top of the World Communities, Inc., is the owner of 13,000± contiguous acres which include all four areas or parcels for which map amendments are requested.  Accordingly, the Plan Amendments are consolidated into this one application.  The requested changes, discussed in detail below, are:

1. 4,211± acres from Rural to Low Density Residential (currently the western portion of the DRI).

2. 108± acres from Medium Density Residential to Multi-Family Residential Medium Density; reduce acreage by 22 acres (the current Circle Square Woods vested residential parcel adjacent to State Road 200), Net 86 acres Multi-Family Residential Medium Density.

3. 22 acres from Medium Density Residential to Commercial (add 20 acres to current Circle Square Woods vested commercial parcel adjacent to State Road 200).

4. 100 acres from Rural to Medium Density Residential (acreage to be added to the OTOW DRI for the Del Webb Spruce Creek development) (see Plan Amendment Application, Vol. II).

The four Plan Amendment areas are identified on the map attached to this Application as Exhibit A. 

In Plan Amendments 1-3, the Applicant proposes to redistribute existing DRI entitlements throughout the DRI property, and existing vested entitlements on the Circle Square Woods vested land, to create a more functional development and to utilize the development entitlements previously obtained.  No new residential or non-residential development is proposed or planned.  Further, no encroachment into the five (5) Conservation Areas previously set aside by the Applicant is proposed or planned.
